Consumer Rights (UK)
Nothing in these Terms and Conditions shall affect the statutory rights of consumers under the Consumer Rights Act 2015 or any other applicable UK legislation.
Services provided by Pilates Hampshire will be delivered with reasonable care and skill in accordance with UK consumer law.
Where services are not provided with reasonable care and skill, clients may be entitled to a repeat performance or, where appropriate, a price reduction, as required by law.
Limitation of Liability (UK Compliance)
Nothing in these Terms shall limit or exclude liability for:
Death or personal injury caused by negligence;
Fraud or fraudulent misrepresentation;
Any matter which cannot be limited or excluded under UK law.
Subject to the above, Pilates Hampshire shall not be liable for indirect, consequential, or economic loss, including but not limited to loss of profits, business,
opportunity, or enjoyment.
Clients participate entirely at their own risk and remain responsible for ensuring they are medically fit to engage in physical exercise.
Data Protection and Privacy (UK GDPR)
Pilates Hampshire processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Personal data collected will be used solely for the purposes of administering bookings, memberships, communication, and safe participation in services.
Data will not be shared with third parties except where legally required or necessary for service provision (e.g. booking and payment platforms).
Clients have the right to access, correct, restrict, or request deletion of their personal data in accordance with applicable law.
Cancellation Rights (Distance Selling)
Where a contract is formed online or remotely, clients may have rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
However, by booking a session for a specific date and time, the client acknowledges that statutory cancellation rights do not apply once the service has been fully performed or within the cancellation window applicable to leisure services with a specific date or period of performance.
This does not affect the studio’s own cancellation policy.
Force Majeure
Pilates Hampshire shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, fire, flood, pandemic, government restrictions, strikes, power failure, or equipment breakdown.
In such circumstances, services may be suspended or modified without liability.
Changes to Terms
Pilates Hampshire reserves the right to amend these Terms and Conditions at any time. Updated terms will be published on the website and apply from the date of publication.
Continued use of services constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
